Whim Terms of Use

These terms are an agreement between you and Matchy Labs Ltd (company number 17479437, registered in England and Wales, registered office 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom). Matchy Labs runs Whim ("we", "us"). They cover the Whim iPhone app, the song listening pages Whim makes, and anything else we offer under the Whim name.
By using Whim, you agree to these terms. If you don't agree, please don't use Whim.
Our Privacy Policy explains what data we handle and why. It is a separate document, but you should read it too.
1. Who can use Whim
You must be at least 13 to use Whim.
If you are under 18, or under the age of adulthood where you live, a parent or guardian should read these terms with you and be okay with you using Whim. If you live in the EU, your country may set a higher age, up to 16, for using apps like Whim on your own. If you're under that age, please get a parent's okay first.
You can't use Whim if the law where you live forbids it, or if we have banned you before.
2. Your account and library
In the App Store version, you sign in with Apple after choosing how to start a song and before adding material for it. Sign in with the same Apple account on another device to restore the Whim library linked to it. Whim cannot recover your Apple account if you lose access to it. If an option to import an older guest library is offered, Whim does not automatically merge it with another library already linked to that Apple account.
The separate guest TestFlight version does not require sign-in. It creates a random ID and secret key to recognise your library. The key is saved in your iPhone's keychain and may follow you to another iPhone through iCloud Keychain. If the key is lost and does not return, you may lose access to that guest library; it has no password or email recovery.
In the App Store version, Delete account removes your library and songs from our active service. In the guest TestFlight version, the control is Delete everything. For a signed-in account, Whim also requests revocation of its Apple sign-in credential. If Apple is unavailable, your library is still deleted and Whim retries the revocation. Short-lived backups and copies held by providers can take longer to expire, as the Privacy Policy explains.
Keep your phone and Apple ID secure. Anyone who can use your copy of the app can see and change your songs.
3. What you put in
To make a song, you can give Whim words, lyrics, chat screenshots, photos, voice notes, a hum, the name of a song you like, and an artist name. We call all of this "your input".
Only use input you have the right to use. In plain terms:
- Don't upload lyrics, poems or recordings that belong to someone else unless you have their permission.
- Chat screenshots and photos often show other people: their names, faces, messages and numbers. Only use them if those people would be okay with it. When a song is going to be shared, ask them first.
- Don't put in private details about other people that could hurt them if the song got around, such as health, sex life, religion, or where someone lives.
You keep whatever rights you already have in your input. We don't claim ownership of it.
4. Permission you give us
To run Whim, we need your permission to handle your input and your songs. You give us a worldwide, free, non-exclusive permission to store, copy, process, change the format of, and show your input and your songs, only as needed to:
- make your songs, lyrics and covers;
- keep them in your library and play them back to you;
- show a song on a listening page or in public picks, if you choose to share it;
- review reported songs and keep Whim safe;
- fix problems.
This permission ends when you delete the song or use the account or library deletion control, except for copies someone else already downloaded, and short-lived backups (see the Privacy Policy).
We do not use your input or songs to train music models.
5. Songs made by AI
Whim uses AI models to write lyrics, read images, make cover art and make music. Please know:
- Results vary. The same input can give a different song each time. Some songs will be off, strange, or not what you wanted.
- Songs may sound like existing music. A song can resemble an existing song, voice, melody or artist without anyone meaning it to. We can't check every song against every other song.
- No promise it's original or unique. Someone else may get a song that is similar to yours.
- No promise of copyright. In many countries, songs made mostly by AI may not be protected by copyright at all. We can't promise that you own any rights in a song.
- No promise it doesn't infringe. We don't promise that a song doesn't break someone else's rights.
- AI can get things wrong. Lyrics and covers can misread your screenshots, invent details, or say things you didn't mean. Check a song before you share it.
As between you and us, we don't claim ownership of the songs you make.
6. How you can use your songs
You can use your songs however you want, including to make money from them.
But that is on you. If you use a song, especially in public or commercially, you alone are responsible for making sure you're allowed to. That includes:
- lyrics, recordings or other material you put in;
- anything in a song that sounds like an existing song or sample;
- real people's names, voices or likeness in a song or cover;
- the rules of any platform you post to, such as streaming services or social apps. Many have their own rules about AI music.
Don't claim a song was made without AI when someone is relying on that. Don't use a song to pretend a real artist made it (see section 8).
7. Sharing, listening links and public picks
Your songs are private until you share them.
Listening links. You can make an unlisted link for a finished song. Anyone who has the link can listen, see the lyrics, title, artist name and cover, and download the audio. Links can be passed on. You can turn a link off at any time. Turning it off does not remove copies people already downloaded.
Public picks. You can also offer a song for Whim's public picks. We review each song first and choose which ones to show. Approved songs can be heard by other Whim users. You can take your song out of public picks at any time. We can remove a song from public picks, or decide not to show it, for any reason.
When you share a song, you are responsible for it. Make sure you have the okay of anyone who appears in it.
8. Rules
Don't use Whim to make, share or offer for public picks anything that:
- harasses, bullies, threatens or shames a real person;
- pretends to be someone else, or uses a real artist's name, voice or style to make people think the artist made or approved the song;
- attacks people for their race, ethnicity, nationality, religion, disability, sex, gender identity, sexual orientation, age or similar;
- sexualises anyone under 18, in any way. We report this to the authorities;
- shares sexual content about a real person without their consent;
- shares someone's private information, such as their address, phone number or private messages, to hurt or expose them;
- encourages violence, self-harm or crime;
- breaks the law, or someone's copyright or other rights;
- is spam, or tries to trick people.
And don't:
- try to get into other people's songs, or into our servers;
- overload Whim, use bots or scripts, or get around limits;
- copy, resell or rebuild Whim's service;
- try to get the models to reveal private data.
9. Reporting and removal
In the app. Every song in public picks has a Report button. A reported song is hidden for you straight away. When more than one person reports a song, it leaves public picks until we review it.
By email. To report a listening link, a song that breaks the law, or a song that uses your work or your personal details, email hello@onwhim.app. Please include the link, what is wrong, and, for a copyright claim, what work you own and how to reach you.
We look at reports and may remove a song, turn off its link, remove it from public picks, or limit or block the person who made it. Where the law requires it, we will tell the person affected what we did and why, and how they can object. If you think we got a decision wrong, email us and we will look again.
We don't check every song before it is made or shared by link. We do review every song before it appears in public picks.
10. Invites and credits
We may give you invite codes to share, and credits when people you invite start using Whim, or for other reasons we explain in the app. Some credits start as "pending" and only count once they are confirmed.
Credits:
- have no cash value and can't be exchanged for money;
- can't be sold, traded or moved to someone else;
- are tied to your copy of the app, and are lost if you lose access to it or use the account or library deletion control;
- can change: what they unlock, how you earn them, and whether they expire. We'll say so in the app.
No farming. Don't create fake installs, invite yourself, use bots or scripts, or fake listens to earn credits. If we think credits were gained this way, we can remove them, cancel pending credits, or stop you from earning more.
We may change or end the invite and credit programme at any time.
11. Limits and paid features
The free allowance is shown in the app. Whim Pro unlocks 20 full songs in each rolling 30-day period while the subscription is active. That limit applies to both the yearly and weekly plans. Previews and any other limits are shown in the app. Unused full-song allowance does not carry over to the next 30-day period. If a generation fails without delivering a full song, we restore its song credit. The separate guest TestFlight build remains free and does not sell Whim Pro.
Whim Pro has two auto-renewing plans sold through Apple's in-app purchase system: a yearly plan with a three-day free introductory trial for eligible customers, and a weekly plan without a trial. Prices vary by country and appear in the app and Apple's purchase sheet before you confirm. A monthly equivalent shown for the yearly plan is for comparison; Apple bills the full yearly price after the trial and at each renewal. At the current US base price, that is $71.90 per year; the weekly US base price is $3.99 per week. The exact local price charged is the one Apple displays when you subscribe.
If you are eligible for the yearly trial, Apple charges nothing for the first three days and then charges the annual price unless you cancel before the trial ends. Introductory-offer eligibility is determined by Apple and may be unavailable if you have used an offer in the same subscription group before. If you are not eligible, Apple's purchase sheet shows the charge before confirmation. The weekly plan renews at its weekly price with no free trial. Apple charges your Apple Account and manages renewals, billing, refunds and cancellation. To avoid another charge, cancel in your Apple Account's subscription settings before the current trial or billing period ends. Deleting the Whim app or your Whim account does not cancel an Apple subscription. You can use Restore in Whim to recover an active purchase tied to your Apple Account.
Paid access ends when Apple or RevenueCat reports that the subscription is no longer active, including after expiration, revocation or a refund. If Apple offers a grace period after a failed renewal, access during that period follows the status Apple reports. The app may take a short time to receive an updated purchase status; use Restore or contact hello@onwhim.app if an active purchase does not appear.
12. Changes to Whim, and ending it
Whim is a young app. We may add, change or remove features, change limits (for example how many songs you can make), or pause or close Whim. We will try to warn you in the app before a big change. If we close Whim, we will try to give you at least 30 days to save your songs.
You can stop using Whim at any time. Use Delete account in the App Store version, or Delete everything in guest TestFlight, to remove your data from our server.
We can suspend or block your use of Whim, or remove your songs, if you break these terms, if the law requires it, or to protect other people or Whim. Where it's reasonable, we'll tell you first.
13. Our responsibility
We provide Whim as it is. We work to keep it running well, but we can't promise it will always work, be free of errors, or keep your songs forever.
We are not responsible for:
- losses you could not reasonably expect when you started using Whim;
- losing a guest library because its key cannot be restored, or losing a library you chose to delete;
- how you use your songs, or what other people do with songs you shared;
- claims that a song you used breaks someone else's rights.
If we are responsible for a loss, our total liability is limited to £100, or what you paid us in the 12 months before, if that is more.
Nothing in these terms limits:
- our liability for death or personal injury caused by our negligence;
- our liability for fraud or fraudulent misrepresentation;
- any other liability that the law says can't be limited or excluded;
- your legal rights as a consumer. In the UK, these include your rights under the Consumer Rights Act 2015. For example, if digital content we supply damages your device or other content because we didn't take reasonable care, you may be entitled to a repair or compensation. If you pay for digital content, it must be as described, fit for purpose and of satisfactory quality. If you are in the EU, you keep the rights your country's consumer law gives you.
This section applies as far as the law allows.
14. If you break the rules
If someone makes a claim against us because of input you uploaded, or a song you shared or used in breach of these terms or someone's rights, you are responsible for the harm you caused, as far as the law allows.
15. Law and disputes
These terms are governed by the laws of England and Wales. Disputes go to the courts of England and Wales.
If you are a consumer living elsewhere in the UK or in the EU, you also keep the protection of the mandatory consumer laws of where you live. You can bring a claim in the courts where you live, too. In Scotland or Northern Ireland, you can use your local courts.
Please contact us first if something is wrong. Most problems can be sorted out by email.
16. Apple
You got Whim from Apple's App Store. These points apply to that:
- These terms are between you and us, not Apple. We, not Apple, are responsible for Whim and its content.
- Licence. We give you a personal, non-transferable licence to use Whim on any Apple-branded device you own or control, as allowed by Apple's Usage Rules in the App Store Terms of Service. Family Sharing and Apple's volume purchase programme may also allow use by others.
- Support. We, not Apple, are responsible for support and maintenance of Whim. Apple has no duty to provide support for it. Contact us at hello@onwhim.app.
- Warranty. If Whim fails to meet a warranty that applies to it, you can tell Apple, and Apple will refund the price you paid for Whim, if any. As far as the law allows, Apple has no other warranty duty for Whim. Any other claims, losses or costs from a failure to meet a warranty are ours, as set out in these terms.
- Claims. We, not Apple, are responsible for handling any claims about Whim or your use of it, including product liability claims, claims that Whim fails a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- Rights of others. If someone claims that Whim, or your having or using it, infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and resolving the claim.
- Where you are. You confirm that you are not in a country that is subject to a US government embargo or has been named by the US government as a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties.
- Our details. Questions, complaints or claims about Whim go to Matchy Labs Ltd, 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom, at hello@onwhim.app.
- Other services. When you use Whim, you must also follow the terms of any other service you use with it, such as your mobile network.
- Apple can enforce these terms. Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.
If this section conflicts with the rest of these terms, this section wins for anything to do with Apple.
17. Other things
If a part of these terms turns out to be invalid, the rest still applies.
If we don't enforce a rule straight away, we can still enforce it later.
We may pass these terms to another company that takes over Whim. Your rights under these terms stay the same. You can't pass your rights under these terms to someone else.
We may update these terms. If a change matters, we will tell you in the app before it takes effect. If you keep using Whim after that, the new terms apply. If you don't agree, you can stop using Whim and delete your data.
